These Terms of Service ("Terms") explain how you may access and use the GoStudious platform and the rights and responsibilities of everyone who uses it.

Our goal is simple:

To provide a safe, intelligent and engaging learning platform that helps students achieve their academic potential while supporting parents, teachers, tutors and schools.

We have written these Terms in plain English because we believe legal documents should be understandable, not intimidating.

Please read them carefully before using GoStudious.

Part 1: Introduction, Definitions, Eligibility, Accounts

1. Introduction

1.1 About GoStudious

GoStudious is an AI-powered education technology platform designed to support learning through personalised educational experiences.

Depending on your subscription and account type, GoStudious may provide access to:

• AI Tutors
• Diagnostic Assessments
• Personalised Learning Journeys
• Language Lift
• Revision Notes
• Video Lessons
• Interactive Quizzes
• Practice Questions
• Progress Tracking
• Parent Dashboards
• Tutor Dashboards
• School Dashboards
• AI-generated explanations
• AI-assisted feedback
• future educational AI services that we introduce from time to time.

Some features may only be available through paid subscriptions or school licences.

1.2 Our Mission

Our mission is to make high-quality education more accessible through technology while ensuring that learning remains safe, ethical and centred on human development.

Education-specific Artificial intelligence is designed to support—not replace—teachers, tutors, parents or independent learning.

1.3 These Terms form a legal agreement

These Terms form a legally binding agreement between:

GoStudious Limited ("GoStudious", "we", "our" or "us")

and

each person or organisation that accesses or uses our Services.

Depending on the circumstances, this may include:

• students
• parents
• legal guardians
• teachers
• tutors
• schools
• colleges
• Multi Academy Trusts
• educational organisations
• any other authorised users.

If you are using GoStudious on behalf of a school or organisation, you confirm that you have authority to accept these Terms on behalf of that organisation.

These Terms should be read together with our:

• any additional service-specific terms we publish.

Where those documents apply, they form part of your agreement with us.

If there is any inconsistency, these Terms will generally take precedence unless another policy expressly states otherwise.

2. Definitions

To make these Terms easier to understand, certain words have specific meanings.

Account: An account created to access the Services.

AI: Artificial intelligence technologies used within the Services, including machine learning models, large language models, automated assessment tools, recommendation systems and future AI technologies.

AI Tutor: The AI-powered educational assistant provided by GoStudious to support learning through explanations, questions, hints, guidance and personalised educational support.

Community Standards: The rules explaining acceptable behaviour when using GoStudious.

Content: All educational materials, software, graphics, videos, questions, assessments, text, images, AI outputs and other materials available through the Services.

Diagnostic Assessment: An assessment designed to evaluate a student's current level of understanding so that GoStudious can recommend an appropriate learning pathway.

Language Lift: GoStudious' literacy and vocabulary support feature, designed to help students better understand educational language, subject terminology and examination vocabulary.

Parent: A parent, guardian or other adult legally responsible for a student.

Personalised Learning Journey: The adaptive learning pathway generated using assessment data, learner interactions and educational progress.

School: A school, college, academy, Multi Academy Trust or other educational institution using GoStudious.

Services: The GoStudious website, mobile applications, software, educational tools, AI services and related products made available by us.

Student: Any learner who accesses the Services.

Tutor: A private tutor or an independent educational professional using GoStudious.

User: Anyone who accesses or uses the Services.

3. Who These Terms Apply To

These Terms apply to every person or organisation using GoStudious, including:

• students
• parents
• schools
• teachers
• tutors
• administrators
• visitors who create an account
• organisations purchasing subscriptions
• future enterprise customers.

Different account types may have different permissions and responsibilities.

Where additional terms apply to a particular type of user, those terms supplement these Terms rather than replace them.

4. Acceptance of these Terms

By accessing or using GoStudious you confirm that:

• you have read these Terms;
• you understand them;
• you agree to comply with them; and
• you are legally permitted to enter into this agreement.

If you do not agree to these Terms, you must not use the Services.

If you are under the age at which you can legally enter into contracts in your country, your parent, guardian or authorised school must accept these Terms on your behalf where required by applicable law.

5. Changes to these Terms

Technology evolves quickly, particularly in the field of artificial intelligence.

We may update these Terms from time to time to:

• improve clarity;
• introduce new Services;
• reflect changes in technology;
• reflect changes in law;
• improve safeguarding;
• improve security;
• improve educational features; or
• support new countries or educational systems.

Where a change materially affects your rights, we will take reasonable steps to notify you before it takes effect.

The latest version will always be available on our website.

Your continued use of the Services after updated Terms take effect means you accept those updated Terms.

6. Eligibility

6.1 Minimum age

GoStudious is designed for learners of different ages.

The way an account is created depends on the user's age, local law and whether the account is created independently, by a parent or by a school. Children under the age of 3 will require parents or guardians to sign up on their behalf.

6.2 Student accounts

Students may only create accounts where permitted by law and by our registration process.

For younger students, registration mus be completed by:

• a parent;
• a legal guardian; or
• an authorised educational institution.

6.3 Parent responsibility

Where a parent creates or manages a student's account, the parent confirms that they:

• have authority to do so;
• have provided accurate information;
• will supervise the student's use where appropriate; and
• are responsible for subscription payments associated with that account unless otherwise agreed.

6.4 School accounts

Schools are responsible for ensuring that they have obtained any permissions required under applicable law before creating or managing student accounts.

Schools remain responsible for their educational decisions and safeguarding obligations.

6.5 International users

GoStudious is based in the United Kingdom but may also be made available in Zimbabwe and other countries.

Users are responsible for ensuring that their use of the Services complies with local laws.

Nothing in these Terms removes any mandatory legal rights that users have under applicable consumer protection or data protection legislation.

7. Creating a GoStudious Account

To access many features of GoStudious, you must create an Account.

When creating an Account, you agree to:

• provide accurate information;
• keep your information up to date;
• use your real identity where required;
• protect your login credentials; and
• notify us promptly if you believe your Account has been compromised.

We may refuse to create an Account where we reasonably believe that doing so would:

• breach the law;
• create a safeguarding risk;
• compromise platform security; or
• undermine the integrity of the Services.

8. Student Accounts

Student Accounts are intended solely for educational use.

Students must use GoStudious honestly and responsibly.

Students must not:

• impersonate another person;
• share their login details;
• attempt to gain unauthorised access to other accounts;
• misuse AI features to cheat or deceive;
• interfere with the learning of other users; or
• use the Services for unlawful purposes.

Where a Parent or School manages the Student Account, certain features, communications and settings may also be accessible to that Parent or School.

9. Parent Accounts

Parents play an important role in supporting their child's education.

Parent Accounts may allow parents to:

• create linked Student Accounts;
• manage subscriptions;
• view learning progress;
• receive safeguarding notifications where appropriate;
• manage permissions;
• communicate with GoStudious regarding their child's use of the Services.

Parents remain responsible for ensuring that information they provide is accurate and up to date.

10. School Accounts

Schools may create and manage Accounts for authorised staff and students in accordance with these Terms and any separate School Agreement.

Schools are responsible for:

• assigning appropriate user roles;
• maintaining accurate records;
• ensuring only authorised users access the Services;
• complying with applicable education and data protection laws; and
• notifying us promptly if they become aware of any unauthorised use.

Where a School provides student information to GoStudious, the School confirms that it has a lawful basis to do so.

11. Teacher and Tutor Accounts

Teachers and Independent Tutors may use GoStudious to support teaching and learning.

Teachers and Independent Tutors remain professionally responsible for the educational decisions they make.

GoStudious provides technology and educational tools but does not replace professional judgement or teaching responsibilities.

Nothing in these Terms creates an employment relationship, agency or partnership between GoStudious and any Tutor.

12. Account Security

You are responsible for maintaining the confidentiality of your login credentials.

You must:

• choose a strong password;
• keep your login details confidential;
• not share your Account except where expressly permitted;
• notify us immediately if you suspect unauthorised access.

We may temporarily suspend an Account where we reasonably believe it has been compromised or poses a risk to users, the platform or our Services.

13. Closing Your Account

You may close your Account at any time through your account settings or by contacting us.

Closing an Account does not automatically cancel any active subscription unless cancellation is completed in accordance with the applicable subscription terms.

Some information may be retained where required by law, to protect users, resolve disputes or comply with our legal obligations. Further information is available in our Privacy Policy.

Part 2 — Using GoStudious and Our Educational Services

14. Contacting Us

If you have any questions about these Terms or the Services, you can contact GoStudious using the contact details published on our website.

Where possible, we encourage users to contact us through their registered account so that we can respond more efficiently.

15. Using GoStudious

15.1 Licence to use the Services

Subject to these Terms, GoStudious grants you a limited, non-exclusive, non-transferable and revocable licence to access and use the Services for your own educational, teaching or administrative purposes.

This licence does not transfer ownership of the Services or any intellectual property rights to you.

You may only use the Services in accordance with these Terms and any applicable laws.

15.2 Personal educational use

Unless we expressly agree otherwise in writing, the Services are intended for personal educational use or authorised educational use within a school or organisation.

You may not use the Services for commercial resale, redistribution or any unauthorised business activity.

15.3 Lawful use

You agree to use GoStudious responsibly and lawfully at all times.

You must not use the Services to:

• commit or encourage unlawful activity;
• infringe another person's rights;
• upload malicious software or code;
• interfere with the operation of the platform;
• gain unauthorised access to systems or accounts; or
• disrupt the learning experience of other users.

15.4 Respecting other users

GoStudious is a learning community.

All users are expected to treat others with respect.

Bullying, harassment, discrimination, abusive language, threats or other inappropriate behaviour are prohibited.

Further guidance is available in our Community Standards.

16. Acceptable Use

16.1 Educational purpose

GoStudious has been designed to support learning.

You agree to use the Services honestly and in a way that supports genuine educational development.

16.2 Academic integrity

Learning is most effective when students complete work themselves.

You must not use GoStudious to:

• submit work created entirely by AI where this is prohibited by your school, examination board or educational institution;
• impersonate another learner;
• cheat in assessments;
• manipulate learning records;
• falsify educational progress;
• obtain unfair academic advantage.

Our AI tools are intended to explain, support and develop understanding—not to replace genuine learning.

16.3 Platform misuse

You must not:

• attempt to bypass platform restrictions;
• interfere with security measures;
• create multiple accounts to avoid suspensions or subscription limits;
• use bots or automated scripts unless authorised;
• probe or test vulnerabilities without permission;
• interfere with another user's account or learning experience.

16.4 Reverse engineering

Unless permitted by law, you must not:

• reverse engineer;
• decompile;
• disassemble;
• copy;
• replicate;
• modify;
• create derivative works from;

any part of the Services.

16.5 AI training prohibition

The educational materials, AI responses, datasets, prompts and outputs available through GoStudious must not be used to train, improve or develop other artificial intelligence systems without our prior written permission.

This includes automated data collection, scraping or extraction for machine learning purposes.

16.6 Automated access

You must not use automated tools to access the Services unless expressly authorised by us.

This includes:

• scraping;
• web crawlers;
• automated downloading;
• automated account creation;
• prompt harvesting;
• model extraction techniques.

Reasonable indexing by recognised search engines may be permitted where authorised.

17. Educational Services

17.1 Educational support

GoStudious provides educational technology designed to support learning.

Our Services may include:

• revision resources;
• AI-assisted explanations;
• practice questions;
• quizzes;
• assessments;
• diagnostic tools;
• progress tracking;
• educational recommendations;
• personalised learning pathways.

These Services are intended to support—not replace—teachers, tutors, parents or independent study.

17.2 No guarantee of educational outcomes

Every learner is different.

Although our Services are designed to improve learning, we cannot guarantee:

• examination results;
• grades;
• university admissions;
• school admissions;
• scholarships;
• academic progression; or
• specific educational outcomes.

Progress depends on many factors beyond our control, including effort, attendance, teaching quality and individual circumstances.

17.3 Human judgement

Educational decisions should always involve human judgement.

Important academic, safeguarding or educational decisions should not be based solely on AI-generated recommendations.

18. Diagnostic Assessment

18.1 Purpose

Diagnostic Assessments help us understand a student's current level of knowledge.

They enable GoStudious to recommend an appropriate learning pathway and identify areas where additional support may be beneficial.

18.2 Adaptive learning

Assessment results may be used to personalise:

• lesson recommendations;
• practice questions;
• revision plans;
• AI Tutor responses;
• Language Lift activities;
• learning priorities.

18.3 Educational recommendations

Diagnostic recommendations are educational guidance only.

They are not professional educational assessments or formal academic evaluations.

Schools, parents and teachers remain responsible for educational decisions.

18.4 Reassessment

Students may be invited to complete additional Diagnostic Assessments as their learning develops.

These assessments help improve personalisation and monitor progress over time.

19. Personalised Learning Journey

19.1 Personalised support

GoStudious may generate an individual learning journey based on information such as:

• Diagnostic Assessment results;
• completed activities;
• learning progress;
• strengths;
• areas for improvement;
• selected subjects;
• educational goals.

19.2 Dynamic recommendations

As students continue learning, recommendations may change automatically.

This helps ensure learning remains appropriate to each student's current level.

19.3 Continuous improvement

Personalised Learning Journeys are continually refined as new information becomes available.

Recommendations may therefore change over time without prior notice.

20. Language Lift

20.1 Purpose

Language Lift is GoStudious' literacy support feature.

Its purpose is to help students understand educational vocabulary, examination language and subject-specific terminology across different curriculum areas.

20.2 Support provided

Depending on the subject studied, Language Lift may:

• explain unfamiliar words;
• simplify complex language;
• define technical vocabulary;
• highlight examination command words;
• improve reading comprehension;
• support written communication;
• reinforce academic vocabulary.

20.3 Educational assistance

Language Lift provides educational support only.

Students should continue developing independent reading, writing and communication skills.

20.4 Subject-specific support

Language Lift may operate differently across subjects.

For example:

• Mathematics may focus on interpreting examination questions and mathematical terminology;
• Science may explain technical scientific language;
• English may support vocabulary, comprehension and writing;
• future subjects may include tailored language support appropriate to those disciplines.

21. AI Tutor

21.1 Educational assistant

The AI Tutor is designed to provide personalised educational support.

It may:

• explain concepts;
• answer questions;
• generate examples;
• suggest revision strategies;
• provide hints;
• recommend practice activities;
• adapt explanations based on learner progress.

21.2 Not a human teacher

The AI Tutor is an educational technology tool.

It is not:

• a qualified teacher;
• a tutor;
• an educational psychologist;
• a professional adviser;
• a substitute for classroom teaching.

21.3 Verifying information

Although we work to improve the quality of AI responses, AI-generated content may occasionally be inaccurate, incomplete or outdated.

Users should verify important educational information using reliable sources.

21.4 Learning support

The AI Tutor is designed to encourage understanding rather than simply providing answers.

In some situations, it may intentionally provide hints or guided explanations instead of complete solutions.

22. AI-Generated Explanations

22.1 Educational purpose

AI-generated explanations are intended to support understanding.

They should not be regarded as official examination guidance or definitive academic advice.

22.2 Variations in responses

Because AI systems are probabilistic, responses may vary between users or over time.

Different explanations may all be educationally appropriate.

22.3 Improving quality

We continually evaluate and improve our AI systems.

This may include:

• updating prompts;
• changing AI models;
• introducing new technologies;
• improving educational accuracy;
• refining safety systems.

23. Parent, Tutor and School Dashboards

23.1 Dashboard functionality

Depending on account type, GoStudious may provide dashboards enabling authorised users to monitor learning activity.

These dashboards may include:

• progress summaries;
• assessment information;
• learning recommendations;
• assignment completion;
• safeguarding notifications where appropriate;
• subscription information.

23.2 Educational oversight

Dashboard information is intended to support educational oversight.

It should not be interpreted as a complete assessment of a student's educational performance.

23.3 Permissions

The information visible within a dashboard depends on:

• the account type;
• permissions granted;
• applicable law;
• safeguarding requirements;
• school settings.

Part 3 — Artificial Intelligence, Safeguarding, Schools, Tutors, Subscriptions and Platform Evolution

24. Educational Integrity

24.1 Supporting genuine learning

GoStudious is committed to promoting honest learning.

Users must use AI responsibly and in ways that enhance understanding rather than replace independent effort.

24.2 Examination compliance

Students remain responsible for complying with the rules of their examination boards, schools, colleges and educational institutions.

GoStudious cannot determine whether AI use is permitted in every educational context.

24.3 Responsible AI use

Where AI assistance is permitted, students should ensure that submitted work accurately reflects their own understanding unless otherwise authorised.

24.4 Reporting misuse

Where we reasonably believe that our Services are being used dishonestly or in breach of these Terms, we may investigate the matter and take appropriate action under Section 36 (Suspension and Termination), which is set out later in these Terms.

25. Responsible Artificial Intelligence

25.1 Our approach to AI

Artificial intelligence is central to many of the Services offered by GoStudious. We are committed to developing and using AI responsibly, safely and transparently.

Our AI systems are designed to enhance learning, support educators and provide personalised educational experiences. They are not intended to replace teachers, tutors, parents or independent judgement.

We aim to develop AI that is:

• educationally beneficial;
• age-appropriate;
• secure;
• transparent where reasonably practicable;
• continuously monitored for quality; and
• aligned with our AI Policy.

25.2 Human oversight

Although AI can provide valuable educational support, meaningful human oversight remains important.

Parents, teachers, tutors and schools should continue to supervise learning where appropriate and should not rely exclusively on AI-generated content when making important educational decisions.

25.3 AI limitations

Artificial intelligence is constantly evolving and has inherent limitations.

AI responses may occasionally:

• contain factual inaccuracies;
• misunderstand a question;
• omit relevant information;
• generate incomplete explanations;
• reflect outdated information;
• produce different responses to similar questions.

Users should exercise judgement and verify important information where appropriate.

25.4 Continuous improvement

To improve educational quality and platform safety, we may:

• refine prompts;
• retrain internal systems;
• improve educational logic;
• adjust safety filters;
• replace AI providers;
• introduce newer AI models;
• retire older technologies.

These improvements are part of the normal evolution of the Services and may affect how AI responses are generated.

25.5 Future AI technologies

As technology develops, GoStudious may introduce additional AI-powered educational features, including intelligent study assistants, learning agents, voice interactions, adaptive revision tools and other educational innovations.

Any new AI services will remain subject to these Terms unless separate terms are provided.

26. AI Moderation and Abuse Detection

26.1 Keeping the platform safe

To help maintain a safe learning environment, GoStudious may use automated technologies together with human review to identify behaviour that may breach these Terms or our Community Standards.

This may include detecting:

• abusive language;
• bullying;
• discriminatory content;
• attempts to bypass safety measures;
• spam;
• suspicious account activity;
• unusual login behaviour;
• misuse of AI tools;
• attempts to compromise platform security.

26.2 Review process

Not all alerts result in enforcement action.

Where appropriate, automated findings may be reviewed by authorised personnel before action is taken.

26.3 Educational focus

Our moderation systems are designed to support education and safety rather than punish users.

Where appropriate, we may provide educational warnings or guidance before taking stronger enforcement action.

26.4 False positives

Automated systems are not perfect.

They may occasionally identify behaviour incorrectly.

If you believe your account has been affected in error, you may contact us to request a review.

27. Safeguarding

27.1 Our commitment

The safety and wellbeing of children and young people are fundamental to the way we design and operate GoStudious.

We seek to build a platform that supports safe learning while recognising that safeguarding is a shared responsibility involving parents, schools, tutors and other authorised adults.

27.2 Technology-assisted safeguarding

GoStudious may use technology to help identify indicators that could suggest safeguarding concerns.

These indicators may include patterns of behaviour, communications, reports from users or other information available through the Services.

Our systems are designed to assist safeguarding processes. They are not a substitute for human judgement or professional safeguarding procedures.

27.3 Safeguarding notifications

Where we reasonably believe that a safeguarding concern may exist, we may, where appropriate and lawful:

• notify a parent or guardian;
• notify an authorised school representative;
• restrict access to certain features;
• escalate the matter internally;
• report concerns to relevant authorities where required by law or where necessary to protect an individual from serious harm.

The action taken will depend on the circumstances and our legal obligations.

27.4 No guarantee of detection

Although we continually improve our safeguarding measures, no technology can detect every safeguarding issue.

GoStudious does not guarantee that all risks, behaviours or concerns will be identified or prevented.

27.5 User responsibility

If you become aware of behaviour that may place someone at risk, you should report it promptly using the reporting tools available on the platform or by contacting us directly.

In situations involving immediate danger, users should contact the appropriate emergency services or relevant authorities without delay.

28. Schools

28.1 School responsibilities

Schools using GoStudious remain responsible for:

• educational decisions;
• safeguarding responsibilities;
• obtaining necessary permissions and consents;
• complying with applicable laws;
• supervising students;
• maintaining appropriate internal policies.

GoStudious provides educational technology but does not assume the statutory responsibilities of schools or school staff.

28.2 School administrators

School administrators are responsible for:

• creating and managing user accounts;
• assigning appropriate permissions;
• removing access when required;
• ensuring information remains accurate.

28.3 School data

Where a School provides personal information to GoStudious, the School confirms that it has an appropriate legal basis for doing so.

The respective responsibilities of GoStudious and the School for personal data processing may also be set out in a separate Data Processing Agreement where required.

28.4 Educational decisions

Recommendations generated by GoStudious should be considered alongside professional educational judgement.

Schools remain responsible for decisions relating to curriculum, teaching, assessment and student welfare.

29. Teachers and Tutors

29.1 Professional responsibility

Teachers and Tutors remain professionally responsible for the advice, teaching and support they provide.

GoStudious supplies educational technology and does not supervise or direct professional educational practice.

29.2 Independent status

Unless expressly agreed in writing, Tutors using GoStudious act as independent professionals.

Nothing in these Terms creates an employment relationship, agency, partnership or joint venture between GoStudious and any Tutor.

29.3 Appropriate conduct

Teachers and Tutors using the Services agree to:

• behave professionally;
• communicate appropriately;
• comply with safeguarding obligations;
• respect student privacy;
• use AI responsibly;
• comply with applicable laws and professional standards.

29.4 Verification

Where GoStudious offers tutor verification or professional profiles, verification confirms only that specified checks have been completed at the relevant time.

Verification should not be interpreted as a guarantee of suitability, competence or future conduct.

30. Subscriptions and Payments

30.1 Subscription options

GoStudious may offer:

• free plans;
• premium individual subscriptions;
• family subscriptions;
• tutor subscriptions;
• school licences;
• enterprise subscriptions;
• promotional offers;
• free trials.

The features available under each subscription will be described at the time of purchase.

30.2 Fees

Subscription fees must be paid in accordance with the pricing displayed when the subscription is purchased.

Unless stated otherwise, prices include applicable taxes where required by law.

30.3 Renewals

Where a subscription renews automatically, we will explain this before purchase.

You may cancel automatic renewal before the next renewal date through your account settings or by contacting us.

30.4 Free trials

Where free trials are offered, additional terms may apply.

Unless cancelled before the trial ends, a paid subscription may begin automatically where this was clearly disclosed during sign-up.

30.5 Price changes

We may change subscription prices from time to time.

Where the change affects an existing subscription, we will provide reasonable advance notice before the new price takes effect.

30.6 Failed payments

If payment cannot be collected, we may:

• retry payment;
• suspend premium features;
• downgrade the account;
• cancel the subscription following reasonable notice.

30.7 Refunds

Refunds are provided in accordance with:

• applicable consumer protection laws;
• these Terms;
• any refund policy published at the time of purchase.

Nothing in these Terms affects statutory consumer rights that cannot legally be excluded.

31. Beta Features

31.1 Early access

From time to time, GoStudious may offer experimental or beta features to selected users.

These features allow us to test new educational technologies before wider release.

31.2 Availability

Beta features may:

• change significantly;
• contain errors;
• be modified without notice;
• be withdrawn at any time.

Users participate in beta programmes voluntarily.

31.3 Feedback

We welcome feedback regarding beta features.

By providing feedback, you grant GoStudious a worldwide, royalty-free licence to use that feedback to improve the Services without additional compensation.

Part 4 — Intellectual Property, Privacy, Availability, Suspension, Liability and General Provisions

32. Platform Evolution

32.1 Continuous development

Technology evolves rapidly.

To continue improving the Services, GoStudious may modify the platform from time to time.

This may include:

• redesigning interfaces;
• improving workflows;
• changing navigation;
• replacing technologies;
• introducing new educational features;
• retiring older functionality.

32.2 AI provider changes

GoStudious may change, replace or combine AI providers and AI models without prior notice where reasonably necessary to:

• improve educational quality;
• enhance safety;
• increase performance;

Except for the limited licence granted under these Terms, no ownership rights are transferred to you.

33.2 Educational Content

Unless expressly stated otherwise, all educational materials available through the Services, including revision notes, videos, assessments, quizzes, illustrations, AI prompts, model answers and learning resources, remain the intellectual property of GoStudious or its licensors.

You may use these materials solely for your own educational purposes or, where applicable, for authorised educational use within your school or organisation.

You must not reproduce, distribute, publish, sell or commercially exploit any educational content without our prior written permission.

33.3 User Content

You retain ownership of any original content that you upload to GoStudious, including notes, assignments, documents or other materials ("User Content").

By uploading User Content, you grant GoStudious a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce and display that content solely to:

• provide the Services;
• personalise learning;
• improve platform functionality;
• maintain security;
• comply with legal obligations; and
• perform the activities described in our Privacy Policy.

We do not claim ownership of your original User Content.

33.4 AI-generated content

AI-generated explanations, recommendations and educational outputs are provided to support learning.

Subject to applicable law, you may use AI-generated outputs for your personal educational purposes.

You must not:

• represent AI-generated content as official examination guidance;
• use AI-generated outputs in a way that infringes the rights of others; or
• redistribute AI-generated content commercially without our written permission.

33.5 Feedback

We welcome suggestions about improving GoStudious.

If you provide ideas, suggestions or feedback, you grant GoStudious a perpetual, worldwide, royalty-free licence to use, modify and incorporate that feedback into the Services without any obligation to compensate you.

33.6 Reporting infringing content.

If you believe content on the Services infringes your intellectual property rights, you may notify us at support@gostudious.co.uk. Your notice should identify the content and where it appears, the right you say is infringed, confirmation that you are the rights-holder or authorised to act, and your contact details. We will review reported content and, where the complaint is justified, remove or disable access to it within 3 business days. Where content has been removed, the user who provided it may submit a counter-notice, and we may reinstate the content where their objection is justified

34. Privacy and Data Protection

34.1 Our commitment

We are committed to protecting personal information and processing it responsibly.

Our collection, use, storage and sharing of personal information is governed by our Privacy Policy.

34.2 Applicable laws

Where applicable, we process personal information in accordance with:

• the UK General Data Protection Regulation (UK GDPR);
• the Data Protection Act 2018;
• applicable children's privacy requirements;
• Zimbabwean the Cyber and Data Protection Act [Chapter 11:12] (2021); and

Where a School or organisation provides personal information to GoStudious, each party will comply with its respective legal responsibilities.

Where the Services are made available outside the United Kingdom, personal information may be transferred and processed in accordance with applicable data protection laws and appropriate safeguards. Refer to GoStudious Safeguarding Policy.

35. Service Availability

35.1 Availability

We aim to make the Services available whenever reasonably possible.

However, we do not guarantee uninterrupted or error-free access.

35.2 Planned maintenance

From time to time we may suspend access to perform:

• maintenance;
• upgrades;
• security improvements;
• infrastructure changes;
• AI model updates.

Where reasonably practicable, we will provide advance notice of planned maintenance.

35.3 Unplanned interruptions

36.2 Termination by you

You may stop using the Services at any time.

Termination of your account does not automatically cancel any outstanding payment obligations incurred before termination.

36.3 Termination by GoStudious

We may terminate your account where you:

• repeatedly breach these Terms;
• engage in unlawful activity;
• seriously misuse the Services;
• compromise platform security;
• infringe intellectual property rights;
• abuse other users; or
• create significant safeguarding risks.

Where appropriate and lawful, we may provide notice before termination.

36.4 Effect of termination

Following termination:

• your right to use the Services ends;
• your access to premium features may cease;
• certain information may be retained where required by law or for legitimate business purposes.
• Sections on Intellectual Property (33), Limitation of Liability (38) and Governing Law (39) continue to apply after these Terms end.

37.1 Educational support

GoStudious provides educational technology and learning support.

The Services are not a substitute for:

• qualified teaching;
• professional educational advice;
• medical advice;
• legal advice;
• psychological services;
• safeguarding professionals.

37.2 No professional advice

Information generated by the Services should not be relied upon as professional advice.

Where specialist advice is required, you should consult an appropriately qualified professional.

37.3 No examination guarantee

Although our Services are designed to support learning, we do not guarantee:

• examination success;
• admission to any educational institution;
• improved grades;
• qualification outcomes;
• employment opportunities.

38. Limitation of Liability

38.1 Liability that cannot be excluded

Nothing in these Terms excludes or limits liability for:

• death or personal injury caused by negligence;
• fraud or fraudulent misrepresentation;
• any liability that cannot lawfully be excluded under applicable law.

38.2 Consumer rights

Nothing in these Terms affects any statutory rights that consumers have under applicable law, including rights under the Consumer Rights Act 2015.

38.3 Limitation of liability

Subject to Section 38.1, GoStudious will not be liable for:

Where permitted by law, our total liability arising out of or in connection with the Services will not exceed the greater of:

• the total subscription fees paid by you during the twelve months immediately preceding the event giving rise to the claim; or
• £100 (or the equivalent local currency where applicable),

unless a higher amount is required by applicable law.

38.5 Events beyond our control

We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, industrial disputes, failures of telecommunications networks, internet outages or government action.

38.6 Indemnity

1. General To the fullest extent permitted by applicable law, you are responsible for your use of the GoStudious Services and for complying with these Terms. You must not use the Services in a manner that causes or contributes to any third-party claim, loss, damage, liability, cost or expense arising from your unlawful conduct, misuse of the Services or breach of these Terms.

2. Students and Parents Where you use the Services as a student or parent/guardian in your personal capacity, you agree, to the extent permitted by applicable law, to indemnify and hold harmless GoStudious and its officers, employees and agents against reasonable losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising directly from:

a. your fraud, deliberate misuse or unlawful use of the Services;

b. your material breach of these Terms;

c. your infringement or misappropriation of a third party's intellectual property, privacy or other rights; or

d. any content or material that you knowingly submit or make available through the Services that infringes a third party's rights or is unlawful. Nothing in this clause requires a student or parent to indemnify GoStudious for losses arising from GoStudious's own negligence, breach of contract, breach of applicable law, fraud or wilful misconduct.

3. Schools and Organisations Where you access or use the Services on behalf of a school, educational institution or other organisation, you represent that you have authority to bind that organisation. The school or organisation agrees to indemnify and hold harmless GoStudious, its affiliates, officers, employees, contractors and agents against reasonable losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising from:

a. the organisation's material breach of these Terms;

b. the organisation's unlawful use or misuse of the Services;

c. the organisation's violation of applicable law or regulation in connection with its use of the Services;

d. the organisation's infringement or misappropriation of any third-party intellectual property, privacy or other rights; or

e. any content, data or materials provided or uploaded by the organisation or its authorised users where the provision or use of that content, data or materials gives rise to a third-party claim.

4. Third-Party Claims Where GoStudious seeks indemnification under this clause, GoStudious will provide you with reasonably prompt notice of the relevant claim, provided that any delay in notification will not relieve you of your obligations except to the extent that you are materially prejudiced by the delay.

5. Control of Defence The party providing the indemnity may, at its own expense, control the defence and settlement of a claim, provided that no settlement may:

a. impose any admission of liability or obligation on GoStudious;

b. require GoStudious to make any payment or take any action; or

c. adversely affect GoStudious's rights or reputation, without GoStudious's prior written consent. GoStudious may participate in the defence of any claim with its own legal advisers at its own expense.

6. Limitations Nothing in this clause requires any user to indemnify GoStudious to the extent that the relevant claim, loss or liability was caused by GoStudious's fraud, wilful misconduct or breach of applicable law. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law, including any rights or remedies that apply to consumers.

7. Survival The obligations under this clause will survive termination or expiry of these Terms to the extent necessary to deal with any claim arising from events occurring before termination or expiry.

39. Governing Law and Dispute Resolution

39.1 United Kingdom

Where you are based in the United Kingdom, these Terms are governed by the laws of England and Wales.

You may bring legal proceedings in the courts of England and Wales or, where applicable, in the courts of Scotland or Northern Ireland.

39.2 Zimbabwe

Where you are based in Zimbabwe, nothing in these Terms removes any mandatory rights that you have under Zimbabwean law.

Any dispute concerning local consumer rights may be brought before the courts or authorities having jurisdiction under Zimbabwean law.

39.3 International users

For users in other jurisdictions, mandatory local consumer protection laws continue to apply where they cannot legally be excluded.

40. General Provisions

40.1 Entire agreement

These Terms, together with the documents expressly incorporated by reference, constitute the entire agreement between you and GoStudious regarding the Services.

40.2 Severability

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue in full force and effect.

40.3 No waiver

You agree that we may communicate with you electronically, including through:

• in-platform notifications;
• account messages; or
• other digital communication methods that we make available.

Electronic communications satisfy any legal requirement for written communications where permitted by law.

40.6 Force majeure

We are not responsible for delays or failures caused by circumstances beyond our reasonable control.

40.7 Third-party rights

Except where expressly stated otherwise, a person who is not a party to these Terms has no right to enforce them.
